1. Agreement
By using Hush ("the App") you agree to these terms. If you do not agree, do not use the App. This agreement is between you and Fabian Schneider ("the developer"), not with Apple.
2. What Hush is — and is not
Hush shows the live picture of HomeKit cameras you already own, dims your screen, and wakes it when you touch it or when a HomeKit motion sensor reports movement. It keeps a record of its own on your device and summarises it per child.
Hush is not a medical device. It does not monitor breathing, heart rate or any other vital sign, it is not designed to prevent sudden infant death syndrome (SIDS) or any other harm, and it does not detect sound or crying. It does not replace an adult looking after a child. Please read the Safety Notice.
3. What the App depends on
The App needs cameras and sensors set up in Apple's Home app, a working network, and an iPhone or iPad that stays on, unlocked and powered. The picture, the sound and the sensor readings come through HomeKit and can be delayed, interrupted or stopped by any of these, without the App noticing or warning you. You are responsible for checking before each use that the App shows what you expect.
4. Licence
You are granted a personal, non-transferable, non-exclusive licence to use the App on Apple devices you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. You may not redistribute, rent or resell the App, or attempt to derive its source code, except where that restriction is prohibited by law.
5. Hush Premium
Hush is free to use with one child and one camera. Hush Premium is a one-time in-app purchase that unlocks more children and cameras, waking on motion sensors, and the night and nap reports. It is not a subscription. Payment is processed by Apple; the price is shown in the App before you buy. You can restore the purchase on your other devices with the same Apple Account in the App's settings. Refunds are handled by Apple under Apple's terms.
6. Maintenance and support
The developer is solely responsible for maintenance and support of the App. Apple has no obligation to provide either. Support requests go to info@fabianschneider.net.
7. Warranty and your statutory rights
Except for the rights the law gives you and which cannot be excluded, the App is provided "as is". Nothing in these terms limits the statutory warranty and consumer rights you have under Austrian and European Union law; those apply in addition to this agreement.
If the App fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price to you. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are the developer's responsibility.
8. Liability
To the extent permitted by law, the developer is not liable for damage arising from use of the App, including damage resulting from an interrupted or delayed picture, sound or sensor reading, or from relying on the App instead of supervision. Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for intent or gross negligence, or under the Austrian Product Liability Act.
9. Claims
The developer, not Apple, is responsible for addressing any claim by you or a third party relating to the App or your possession and use of it, including product liability claims, any claim that the App fails to conform to a legal or regulatory requirement, claims arising under consumer protection, privacy or similar legislation, and any claim that the App or your possession and use of it infringes a third party's intellectual property rights.
10. Legal compliance
You confirm that you are not located in a country subject to a United States Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any United States Government list of prohibited or restricted parties.
11. Third-party terms
You must comply with applicable third-party terms when using the App, in particular those of Apple.
12. Apple as third-party beneficiary
Apple and Apple's subsidiaries are third-party beneficiaries of this agreement, and upon your acceptance of it Apple has the right, and is deemed to have accepted the right, to enforce it against you as a third-party beneficiary.
13. Governing law
Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. If you are a consumer resident in the European Union, you keep the protection of the mandatory law of your country of residence and may bring proceedings in your own courts.
14. Changes
These terms may be updated. Material changes are published on this page with a new date.
